We the undersigned, present this petition to the Congress of the United States of America.
First and foremost, let it be known that we strongly oppose the abuse and sexual misconduct inflicted on all people, most especially our children, the most vulnerable of our society. We feel extreme empathy for the victims of such heinous crimes.
Be it further known that the highest percentages of said deeds occur in the victims own homes. These atrocities are committed generally by an uncle, grandfather, brother, step-brother, father, or step-father. On some rare occasions, these crimes are committed by the female gender of the family.
We as sex offenders, or families of sex offenders, feel the laws that are currently in effect, and those laws to be enacted, are counter productive. There is not a distinction made between a sexually oriented offender, pedophile, or predator. Yet these laws are to be applied all inclusively to these three separate, but very different groups.
As written and carried out, these laws will victimize the people that we most want to protect, the sexually abused children. They will see their loved one ripped from the home and imprisoned. Then they will feel unfounded guilt for “telling.” This time the victimization is perpetrated by the laws that were originally enacted to protect them.
These laws, as written, must be changed, not only for the accused, but also for the mental well-being of the child victim.
Law makers and the public must be well informed and well educated about this situation before effective laws and policies can be created. In the case of sex crimes many myths and misperceptions must be addressed and corrected.
The current and proposed laws and some of their unintended consequences affect society, through increased costs and/or decreased effectiveness of these laws. They also adversely affect the victims, the sex offenders and their families, and the communities in which they live.
There are alternative procedures for dealing with the problem of sex crimes. There are some State programs that have been developed, tested and found to be quite effective.
In order to have programs that will work, we must stop reacting emotionally and blindly to this issue. We must begin to act for the benefit of victims. We must act for the benefit of all the different types of sex offenders. We must act to stop the wanton waste of tax payer dollars. We must stop the hysteria by the media. We must become educated to the real solutions to bring a halt to these types of crimes. Banishment and discrimination do not work!
The first way to improve effectiveness is to measure it. It should be measured in four ways:
1. Track the rates of various types of sex crimes.
2. Measure the progress made in assisting victims in their recovery.
3. Evaluate the risk assessments that are used to determine which sex
offenders are high risk and which offenders are not.
4. The anti-sex crime legislation should be assessed by the ability to
successfully treat and reintegrate low-risk registrants back into their
families and communities safely.
We/you must clean up the Megan’s Law Registry. It was designed to alert citizens of the few dangerous, deviant, predatory, repeat offender pedophiles that might live nearby. The registry is not functioning as intended. Instead of helping, it is terrifying parents. The reason it is so frightening and ineffective is because of the many names listed on the registry. We now have non-dangerous persons listed as well as the most violent.
We the undersigned are asking Congress to revisit the issue with sanity and comprehensive education. We are also asking that the registry, as it stands today, be over-hauled and brought back to the original intent.
