Mark F. Milhollin506873KennesawGAPlease do not throw our (real) clients to the wolves on ths one. Defining who is "a client" will be impossible under the proposal. Since that is basic to the attorney's obligation, this proposed FAO is fraught with danger, both to members of the Bar and to our clients. Our clients have every right to expect us to discharge our professional obligations and to zealously represent them - and not others who may have competing and dubious legal interests. The proposed FAO would not permit attorneys to act in such a manner nor to faithfully serve our (true) client's best interests.

keith e. fryer279037atlantaGAI fully support this Petition and urge the Board to refer this for more study and comment.

Paul Kilpatrick, Jr.418600ColumbusGAAltough well intended, this opinion creates many more problems than it attemps to remedy. In my 42 plus years of practice, the issue which it appears that this opinion attempts to address, has never been a problem, even once out of hundreds of cases.
Edward (Ned) Flynn266536AtlantaGAI whole-heartedly support this petition, and oppose any attempt to create a "duty to creditors" that directly puts the attorney at odds with his client. We are to be advocates for our clients, and should have a duty only to them--- not their creditors. "A servant with 2 masters serves no one", just as "a ship with 2 captains goes no where".

Tom Monk516005AtlantaGAI could not oppose this opinion more. The Bar should not support opinions that put its members in direct conflict with the interests or desires of their clients. This opinion would seek to impose a duty where the law in the area itself is murky and unclear at best.

Kenneth L. Royal617415SavannahGAThe proposed Formal Advisory Opinion Request No. 05-R6 will be a nightmare as presently worded and absolutely should be rejected. Please DO NOT adopt this Advisory Opinion.

Terry Jackson386033AtlantaGAThis rule makes lawyers the guardian of any real, feigned or imagined claim against their clients, requiring them to grant prejudgment remedies and payment to unliquidated claimants against their client. It does not take furtive mind to see the mischief in this rule and other bars, such as CT have shot down such notions as proposed in lieu of much narrower rules. Lawyers serve their clients, not parties who claim to have claims post judgment/settlement against their clients.

Gary Martin Hays340905DuluthGAPlease do not approve this Rule! I am not a collections attorney. I represent injured victims and their families. I serve them, not creditors with a potential claim.
