WE, THE UNDERSIGNED RESIDENTS OF CANADA, draw the attention of the House to the following:

THAT in current federal criminal law, an unborn child is not recognized as a victim with respect to violent crimes;

THAT when a pregnant women in Canada is assaulted or killed, because we offer no legal protection for unborn children today, no charge can be laid in the death of the unborn child;

THAT the vast majority of Canadians (72% according to Environics Poll, Oct 2007; and 70% according to Angus Reid Strategies Poll, March 2008) support laws that protect unborn children from acts of violence against their mothers that also injure or kill the child in her womb.

THAT forcing upon a pregnant woman the death/injury of her unborn child is a violation of a woman's right to protect and give life to her child.

THAT studies show violence against women often begins or escalates during pregnancy.

THEREFORE your petitioners call upon Parliament to support Bill C-484 (The Unborn Victims of Crime Act) which would recognize unborn children as separate victims when they are injured or killed during the commission of an offence against their mothers, allowing two charges to be laid against the offender instead of just one.

Ken Epp is the Member of Parliament for Edmonton Sherwood-Park.

In November 2005, a 19 year old woman in an Edmonton area riding was shot three times in the abdomen and twice in the head by a childhood friend. Olivia Talbot was 27 weeks pregnant at the time, and later her murderer told the court he was out “to get the baby.”

Since 2004 there have been at least 15 notable cases of pregnant women being brutally attacked resulting in the death of their unborn child; in only 2 of these cases did the woman survive. At least 5 pregnant women have been murdered in the past year.

In response, Mr. Epp has tabled a Private Member’s Bill, Bill C-484, which would provide for a separate offence in the death or injury of an unborn child that results from an attack on a pregnant woman.
