On May 4, 2013 Mr. & Mrs Travis Enos submitted an Architectural Alteration Application, (which will referred to as ARC) to the Boynton Oasis Condo Association, INC. that was denied. The ARC plan was to plant 6 Areca palms on the backside of the unit property for added privacy of the unit and for the improvement of landscaping. Many of other units have the areca palms planted and the decision to deny is thought to be an over reach by association powers based not on the " Community-Wide Standard". Below are the association bylaws: 3.04 Exculpation for Action: The Board or any designated "Architectural Review Committee (the ARC), if applicable, may grant, withhold or deny its consent or approval in any instance where such is permitted or required without any liability of any kind therefor so long as the Board of Arc is acting in good faith, on behalf of the association, in seeking to preserve what it deems as the "Community-Wide Standard" of the Condominium 11.05 In no event will such approval be unreasonably withheld nor will any charge be made therefor.
