STATE UNIFORM TRAFFIC CONTROL

316.3045 Operation of radios or other mechanical soundmaking devices or instruments in vehicles;
(1) It is unlawful for any person operating or occupying a motor vehicle on a street or highway to operate or amplify the sound produced by a radio, tape player, or other mechanical soundmaking device or instrument from within the motor vehicle so that the sound is:
(a) Plainly audible at a distance of 25 feet or more from the motor vehicle; or
(b) Louder than necessary for the convenient hearing by persons inside the vehicle in areas adjoining churches, schools, or hospitals.
(2) The provisions of this section shall not apply to any law enforcement motor vehicle equipped with any communication device necessary in the performance of law enforcement duties or to any emergency vehicle equipped with any communication device necessary in the performance of any emergency procedures.
(3) The provisions of this section do not apply to motor vehicles used for business or political purposes, which in the normal course of conducting such business use soundmaking devices. The provisions of this subsection shall not be deemed to prevent local authorities, with respect to streets and highways under their jurisdiction and within the reasonable exercise of the police power, from regulating the time and manner in which such business may be operated.
(4) The provisions of this section do not apply to the noise made by a horn or other warning device required or permitted by s. 316.271. The Department of Highway Safety and Motor Vehicles shall promulgate rules defining "plainly audible" and establish standards regarding how sound should be measured by law enforcement personnel who enforce the provisions of this section.
(5) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318. |

How many officers privately own such audio systems? 4) These systems are a form of human rights abuse due to growing or constant oppression, depression, and anxiety they cause plus persistent sleep disturbance, if not deprivation; civil rights abuse due to violation of city and state laws supposedly protecting "quality of life" and having one group impose their beliefs and lifestyles on others who are not being protected or can't protect their right not to be subjected against their will to all this; environmental abuse by violating the natural conditions we are physically designed to live in; child abuse if children are being subjected to these systems as I have witnessed as well, and explicit pornographic rap music was being played! 5) Petitions are useless since you could file class action suits against your city or town for the above - Include criminal negligence and willful disregard for human life. Mental disorders such as PTSD could be used as fuel as well, particularly if an Iraq veteran going after the wrong terrorists who are actually here in our own backyards! 6)Get all evidence of the violating vehicles such as plate numbers, photos, video; studies on the effects of low frequency sound waves on mental and physical well-being that have been done; proof of police failures, if any, to enforce laws such as vehicle number of officer and video; evidence of any city failures to stop these systems such as arrest records and traffic violation records - Are more systems being sold than cars being ticketed or even seized? What about environmental impact studies? Wee they done by anyone - City, State, Federal Governments? Manufacturers and retail businesses? Environmental groups? Collect evidence of loud music and audio systems being used in torture or like it was used in Panama against Noriega. How many in your city have homes and apartments along main, heavily trafficked roads where your front doors and windows are about 25 feet away from street? 7) Seriously get advice from civil lawyers, ACLU, environmental lawyers or groups, and human rights lawyers or groups to get legal action using above evidence and testimony to hopefully establish a legal precedent to eventually go after your state, and federal government to cease and desist, ban and/or severely restrict these systems as we do pollutive emissions, car speeds, seat belts, helmets laws, and so on for public safety. |

There needs to be laws made to where car audio systems can only be so loud and can't be hear more than 10 feet away with the windows rolled down at max volume. Also bass in car stereos needs to be abolished. If someone gets caught with a loud audio system, first offense: hefty fine. Second offense: heftier fine and confiscation of audio equipment and destroyed. Third offense all of the above plus jail time and impounding the vehicle. Same needs to be done with car with illegal exhaust systems. Does anyone know where I can find a city or state to live in that has seriously cracked down on this problem and have a zero tollerance of this? Also somewhere that does have a ban on hip hop music, loud bass, loud cars? |
